1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Owlsters websites, apps, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Who We Are & What We Provide

Owlster is an online learning platform focused on emerging technologies. We offer individual course purchases (including our "$1 per course" catalog), subscription plans, community features, an AI Mentor, Course Chat, and a BYOC (Bring Your Own Course) builder that generates personalized learning paths.

3. Eligibility & Accounts

  • You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you are under 18, you must have a parent or guardians consent.
  • You are responsible for your account credentials and all activity under your account. Notify us immediately of any unauthorized use.
  • We may require verification (e.g., email or phone) to activate certain features.

4. Plans, Billing, and Refunds

  • Individual Courses: One-time purchase for personal, non-transferable access.
  • Subscriptions: Billed in advance (monthly/yearly) and auto-renew until canceled. You can cancel at any time in your account; access continues through the current paid period.
  • Trials & Promotions: If offered, well state specific terms at sign-up. After trial ends, your subscription converts to a paid plan unless you cancel before renewal.
  • Refunds: We do not offer refunds on subscription fees or individual course purchases. You may cancel your subscription at any time; youll retain access until the end of the paid period. This does not affect any rights you may have under applicable consumer laws that cannot be waived.
  • Taxes & Fees: Prices may exclude applicable taxes and fees, which are your responsibility.

5. BYOC, AI Mentor, and Course Chat

  • AI-generated content may be inaccurate or incomplete. Use discretion and verify critical information. The Service does not provide professional advice.
  • You grant Owlster a non-exclusive license to process prompts and inputs for the purpose of providing the Service. Do not submit confidential, sensitive, or third-party proprietary information you lack rights to use.
  • You are responsible for how you use AI outputs, including ensuring your use complies with applicable laws and third-party rights.

6. License & User Content

We grant you a limited, personal, non-transferable, non-sublicensable license to access the Service and view content for your own learning. Except where expressly allowed, you may not share, resell, or publicly distribute course content.

If you post, upload, or otherwise make available content ("User Content"), you grant Owlster a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and display such content to operate and improve the Service. You represent you have the rights to share User Content and that it does not infringe any third-party rights.

7. Acceptable Use

  • No account sharing or credential selling.
  • No automated scraping, bulk downloading, or circumvention of access controls.
  • No content that is unlawful, harmful, infringing, or violates others privacy or intellectual property.
  • No interference with or disruption of the Service or its infrastructure.

8. Intellectual Property & Takedowns

The Service and all materials therein are protected by intellectual property laws. All rights not expressly granted are reserved by Owlster and its licensors. If you believe content infringes your rights, contact legal@owlster.co with sufficient detail for us to investigate.

9. Third-Party Services

We may integrate with third-party services (e.g., payment processors, hosting, analytics). Your use of those services may be governed by their terms and privacy policies. We are not responsible for third-party services.

10. Termination

We may suspend or terminate access (with or without notice) for any violation of these Terms or to protect the Service or users. Upon termination, your right to use the Service ceases, but provisions that by their nature should survive (e.g., IP, disclaimers, limitations) will remain in effect.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Owlster and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid to Owlster for the Service in the 12 months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Owlster, its affiliates, and personnel from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of competent courts in India for any dispute arising from these Terms or the Service.

15. Changes to Terms

We may update these Terms. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use constitutes acceptance of the updated Terms.
